The costs assessed under Section 2 above, when collected by the judge, shall be delivered to the City Clerk to be paid into the City's current expense fund. These costs shall not be suspended by the judge except when the defendant is indigent and the fact of such indigence is established by clear, cogent and convincing evidence.
