A. Any person desiring to obtain a bulk sale of water from the city shall contact the public works director and make application to obtain such water on forms provided by the public works department.

B. All persons approved to make a bulk purchase of water shall be permitted to do so under the rules established by the Public Works Director. In the event of any dispute as to the means, method, quantity or site of a bulk water sale, the decision of the public works director shall be final.

C. All persons approved to make a bulk purchase of water shall be required to pay the rates and charges set forth in section .040 of this chapter.

D. The person making a bulk purchase of water is required to assume all responsibility for damage to the connection device used to deliver the water, the water lines used for the delivery and the hydrant used as a connection point to the city system. The person permitted to make a connection for purposes of purchasing bulk water shall be responsible for all water used whether taken by that person or others or spilled or lost through misuse of a hydrant.

E. Bulk purchases of water shall only be permitted at the times and the locations indicated by the public works department. Any other taking of water is unpermitted and is theft.

F. Licensed and bonded contractors shall, upon presentation of proof of license and bond, be allowed to obtain a device for connection to the city’s system without payment of a security deposit if the contractor has signed an application indicating the costs of any repairs or replacements of city property will be a lien upon the contractor’s bond and that the contractor will be personally liable for any unpaid claim.

G. Persons who post a security deposit in lieu of paying the hourly rate for public works department assistance in the connection and operation of the connection device, must demonstrate to the satisfaction of the public works department that they are competent to make such connection.

H. Before any security deposit is returned, the public works department shall inspect the hydrant, device and lines of the city to insure no damage has taken place. At the end of any use of a delivery device by a licensed and bonded contractor, the public works department shall inspect the hydrant, device and lines of the city to insure no damage has taken place.
